1. Scope
These general terms and conditions apply to all orders that customers place via Metzgerei Schmid AG's online shop. They regulate the relationship between Metzgerei Schmid AG and the customer. Conditions of the customer that deviate from these General Terms and Conditions will not be recognized.
The online shop's offering is limited to Switzerland and the Principality of Liechtenstein.
2. Offer, order and conclusion of contract
2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order.
2.2 The published product information is continually updated. In exceptional cases, the information may differ from the information on the packaging. In this case, the information on the packaging always applies.
2.3 By clicking the “order” button, the customer places a binding order for the products listed on the order page.
2.4 Immediately after receiving the order, Metzgerei Schmid AG confirms receipt of the order by email. The purchase contract is only concluded when the products are delivered by Metzgerei Schmid AG.
3. Prices and shipping costs
3.1 The prices stated on the product page include statutory VAT and other price components and are in Swiss francs (CHF).
3.2 The products are delivered by Planzer Transport AG. Deliveries to destinations that cannot be reached directly by Planzer are excluded from the flat rate for shipping.
4. Payment Terms
4.1 Payment is made by credit card (Visa, MasterCard, PostFinance), Twint or advance payment.
4.2 Offsetting against unrecognized or not legally established counterclaims from the customer is excluded.
4.3 The customer can only exercise a right of retention if the claims are based on the same contractual relationship.
5. Liability
5.1 Metzgerei Schmid AG excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes.
5.2 Defects must be reported immediately upon receipt of the products. Otherwise, the products are accepted by the customer as being flawless.
5.3 Metzgerei Schmid AG assumes no liability for undeliverable or delayed delivery of products if the causes are an incorrect delivery address and the absence of the recipient or lie with Planzer Transport AG. This also applies to damage caused by moisture, strong heating and other unusual temperature influences or due to improper handling on the part of the buyer.
6. Applicable Law and Place of Jurisdiction Swiss national law applies exclusively. In the event of disputes, the ordinary courts of CH-9000 St.Gallen have exclusive jurisdiction.
